Public offer for access to finiq

1. Terms

1.1. Provider — the sole proprietor [ПІБ ФОП], whose details are in the last section.

1.2. Customer — an individual, a sole proprietor or a legal entity that has accepted this offer.

1.3. Service — the online management accounting service finiq at app.finiq.com.ua, including its Telegram bot.

1.4. Business — a separate set of books in the Service (accounts, transactions, directories, team) created by the Customer. A Subscription is taken out for each Business separately.

1.5. Plan — a set of features and limits of the Service (Lite, Pro, Advanced) with the price stated in the Prices section and on finiq.com.ua.

1.6. Subscription — paid access to the Service for one Business on a Plan for a Period.

1.7. Period — 1, 6 or 12 months paid for in advance.

1.8. Trial — 14 days of free access for a new Business.

2. Subject

2.1. For a fee, the Provider gives the Customer access to the Service (software as a service) for a Business within the chosen Plan, and the Customer pays for it on the terms of this offer.

2.2. Access is provided over the internet; nothing needs to be installed. No rights to the Service (code, design, name) pass to the Customer.

2.3. The Service is a management accounting tool. It is not accounting or tax software, does not file reports and gives no financial, tax or legal advice.

2.4. Use of the Service is also governed by the Terms of Use and the Privacy Policy, which form part of this agreement. On payment and refunds, this offer prevails.

3. Acceptance

3.1. This offer is accepted by paying for a Subscription. From the moment the payment is received, the agreement is concluded in writing (Article 642 of the Civil Code of Ukraine, Article 11 of the Law “On Electronic Commerce”).

3.2. By signing up and using the Trial, the Customer agrees to the Terms of Use; this offer applies to them from the first payment.

3.3. By paying, the Customer confirms having read this offer, the Plan and the Refund Policy, and having the authority to act for the Business.

4. Prices

4.1. Prices are stated in US dollars as an equivalent. Payment is made in hryvnia at the official National Bank of Ukraine rate on the day of payment; the amount due is shown on the payment page before confirmation.

4.2. The Provider may change prices by notifying the Customer by email and on the website at least 30 days in advance. A new price applies from the next Period; a Period already paid is not recalculated.

5. Payment

5.1. A Subscription is paid in advance for the whole Period by bank card through the payment service shown on the payment page, or by bank transfer to the Provider’s account on request.

5.2. The payment obligation is fulfilled when the money is received by the payment service or credited to the Provider’s account.

5.3. Card details are processed by the payment service; the Provider neither receives nor stores them.

5.4. After payment, a receipt is sent to the account’s email address.

6. Trial

6.1. Each new Business gets 14 days with the features and limits of the Advanced Plan, free and without a card.

6.2. When the Trial ends without payment, the Business becomes read-only: the data is kept and can be viewed and exported, but not changed.

6.3. The Provider may extend the Trial at its discretion.

7. Term, renewal and cancellation

7.1. A Subscription lasts for the paid Period.

7.2. If the Customer agreed to automatic renewal when paying, the Subscription renews for the same Period and the card is charged at the start of the new Period; the Provider notifies about the charge by email. If a charge fails, the Provider retries up to 3 times within 7 days, notifying by email; without payment, the Business becomes read-only.

7.3. Automatic renewal can be cancelled at any time in the Business settings or by writing to hello@finiq.com.ua; access remains until the end of the paid Period.

7.4. A higher Plan applies at once, with the difference for the rest of the Period paid in proportion; a lower Plan applies from the next Period. If the Business exceeds the limits of the new Plan, adding transactions, connections or users may be unavailable until it fits them.

7.5. The agreement ends when a Period ends without renewal, when the Business or account is deleted, or when the Provider restricts access for a breach of the Terms of Use, having notified the Customer.

8. Refunds

8.1. Money is refunded under the Refund Policy, which is part of this offer: within 14 days of the first payment for a Business — in full; for 6 or 12 months — for the unused whole months; for a failure on our side — in proportion or by extending the Subscription.

9. Rights and obligations

9.1. The Provider shall give access within the Plan; take reasonable measures for the Service to work without interruption and to protect the data, with daily backups; announce planned maintenance in advance where possible; answer requests within 2 working days.

9.2. The Provider may update the Service and carry out maintenance; change its features without substantially worsening a paid Plan; restrict access for a breach of the Terms of Use or non-payment.

9.3. The Customer shall pay on time, follow the Terms of Use, keep passwords secret and have the right to the data entered into the Service.

9.4. The Customer may use the Service within the Plan, change the Plan and cancel renewal, export their data and contact support.

10. Liability

10.1. The Service is provided “as is”. The Provider does not guarantee that it meets every expectation or works without interruption; its work also depends on banks and other third-party services.

10.2. The Provider is not liable for decisions the Customer makes based on data in the Service; for errors in data received from banks, registers or CRMs or entered by the Customer; for failures of third-party services; or for indirect losses and lost profit.

10.3. The Provider’s total liability under this agreement is limited to the amount the Customer paid for the current Period of the Subscription of the Business concerned. This limit does not apply where the law does not allow it.

10.4. Neither party is liable for failing its obligations because of force majeure, including martial law, hostilities, attacks on infrastructure, power or internet outages and acts of public authorities, for as long as they last.

11. Personal data

11.1. The Provider processes personal data under the Law of Ukraine “On Personal Data Protection” and the Privacy Policy.

11.2. By accepting this offer, the Customer consents to the processing of their personal data needed to perform this agreement.

11.3. By entering data of counterparties and employees, the Customer confirms having a legal basis for it.

12. Disputes and other terms

12.1. Disputes are settled by negotiation: a claim is sent to hello@finiq.com.ua, and the Provider answers within 14 days. If the dispute is not settled, it goes to a court of Ukraine. The law of Ukraine applies.

12.2. Messages by email to the account’s address or to the Provider’s address are written notices.

12.3. A new version of this offer is published on finiq.com.ua at least 14 days before it takes effect; the price of a paid Period does not change.

12.4. If the Customer is a consumer, their rights under the Law of Ukraine “On Consumer Rights Protection” are not limited by this offer.
